1. Bookings
Provisional Confirmation of Availability
Once we receive a request for availability, the going rates for the property and the required amount for deposit would be confirmed
Exclusions & Additional Charges
For properties that come with telephone lines, all outstanding call fees would have to be cleared before leaving
Transportation to the airport is provided to accommodate all properties either free or at a fixed cost for specific items. These rates exclude baggage handling, telephone fees, fax and telegram charges, car rental, food, soft drinks and liquor, and other person items.
2. Initial Deposit
We required a maximum of 50% initial deposit to confirm a property rental booking. We would not enter into any contractual agreement unless the funds have been received. Funds not received within 5 working days nullifies the reservation.
For bookings of less than one week, or bookings made within 30 days of arrival, full payment is required at the time of reservation.
3. Rates
The rental rates are provided by Properties Away. These rates are on a monthly or daily basis. The figures are provided in Thai Baht.
The rates make provisions for maximum occupancy of the property as is indicated on the website. Only persons that have been indicated on the booking form are allowed to stay in the property as visitors.
Endeavor to lets us know as soon as possible if there any changes to your reservation.
Cost of electricity, water and other gardening supplies are separate from the rental rates, unless explicitly stated.
4. Payment Balance
Balance payment are due 30 days before your arrival date. In a situation where we do not receive the balance on or before the due date, Properties Away has the right to terminate the booking while cancellation charges still apply.
5. Cancellation
You reserve the right to cancel at any time by informing us via email. The following terms apply to cancellation.
- More than 30 days to arrival, you forfeit half of your deposit.
- Less than 30 days to your arrival, you forfeit your full deposit.
If for any reason you feel the need to cancel your booking or some part of, you should inform us via email. Cancellation take effect upon receipt of your mail.
6. Changes to booking
We charge 2500 TBH as administration fee for any change made to the booking after it has been confirmed. However, acceptance of such change is subject to the approval of the property owner.
7. Arrival and departure Time
All guests are expected to check in after 12 noon and check out before 12 noon. Unless it has been stated or specified otherwise.
Changes and Cancellations made by Properties Away
In a situation which is highly unlikely that Properties Away or the owners of the properties decide to make a change to confirmed bookings, we would inform you as soon as possible.
Situations that could lead to cancellation includes but not limited to the following;
- The property is damaged or unusable due to reasons beyond our control.
- We are not able to provide you with the exact property you booked for. Properties Away would try its very best to provide you with an alternative, if you are not satisfied with the alternative, a refund in full less the bank charges would be made to you.
Properties Away would not be held liable for any other obligation or claims put forward by the client.
8. Registered Guests
Persons that have been indicated on the booking form are those that can reside at the property as guests. If there are any changes, kindly inform us as soon as possible. It should be noted also that the number of guest staying in the facility must not exceed the maximum allocated capacity with the exception of infants below 2 years.
If for any reason the management in charge of the property or representative of Properties Away realizes that the number of guest residing at the property is in excess of the number on the booking form, you would be required to pay for the additional guests or you may be asked to leave the building
Camping on the property ground is strictly prohibited and it is highly regretted that no pets are allowed except it has be specified or previously agreed upon.
As part of their corporate responsibility, the management responsible for some properties reserve the right to demand that a guest leave a property as a result of any of the following events occurring:
- Male or female guest are invited to the property without prior notice
- Engaging with activities with minors. (Guest would be handed over to the local police)
- Any activity which is deemed to be illegal or immoral being carried out within the confines of the property.
Note that we have a no refund policy.
9. Security Deposit
Although this is not necessarily required, you may be asked to pay a security deposit to the owners and management of the property upon your arrival. This deposit is to cover the cost of any potential damage or breakages during your stay in the premises. This deposit may also be used to take care of incidental expenses and optional services that are provided on the site. The security deposits are returned on departure if there were no extra cost incurred during your stay. It should be noted that Properties Away has no business with the security deposits and as such is not responsible for any difference that might arise between guests and the property management.
10. Insurance
One of the conditions of booking is that the entire party is covered a very detailed travel insurance. This insurance should be acquired on their own and should cover cancellation, flight delays, loss of baggage and any other property and most importantly health insurance.
Considering that deposits and rental payments are not refundable after you have made a reservation and it has been confirmed, the option of a travel insurance to cover any potential loss of money paid to the properties in case of cancellation.
Properties Away and the properties owners are not in any way liable for any accident incurred by you during the use of the properties facilities or any other third party service that was procured locally like water sports, car or motorbike rental.
Properties Away and also the properties owners shall not be responsible for additional expenses incurred or delay that occurs as a result of any inconvenience caused by events outside the control of Properties Away and the properties owners. This includes but not limited to fires, floods, severe weather and natural disasters and so on.
It is assumed that by accepting this contract by Properties Away and the properties owners you have agreed to comply with the requirements stated above in full.
11. Liability Release
Properties Away and the properties owners shall under no circumstances accept responsibility for any loss, expense, damage, claim or injury that may arise directly or indirectly, consequential or otherwise whatsoever, whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodation as described or substituted, or by reason of military action, caused or incurred, revolution or acts of God, or by any agents, employees, subcontractors, servants or third parties whatsoever supplying any of the services or accommodation herein or as substituted.
If for any reason there I need to substitute accommodation and/or services, the properties owners and Properties Away would always work with your best interest at heart and make use of its best efforts to make substitution with an alternative accommodation and/or service of an equal type or something better than what was originally requested for. The right to refuse or discontinue service to any person is the sole responsibility of Properties Away.
12. Complaints
It should be noted that all the properties we provide at Properties Away’s website and anywhere else are provided in good faith.
We atProperties Away shall not accept responsibility for any of the following:
- Any change made to the properties by its owners and were not mentioned in the website
- The details of water supply, electricity or swimming pool filtration systems.
If you make an effort to get in touch with us when you encounter such problems, we would do our very best to make sure the problem is quickly resolved. Properties Away should be notified of any complaint within 24 hours of the problem occurring to the complaint.
If the problem remains unattended to, kindly endeavor to make a written complaint to Properties Away or the property owners within 14 days of the expiration of the rental period. If you vacate the property before the end of the rental period without mutual agreement, this may lead to a loss in your rights to compensation.
You cannot make a claim after vacating the properties if you didn’t present a notification at the time of the problem occurring to the properties owners or Properties Away.
13. Conduct & Behavior
Whoever is renting the property or making the reservation is responsible for any guest staying in the property on his behalf. Should a member of the party behave in a manner that is deemed inappropriate, the property’s owner/management or Properties Away representative reserve the right to demand that offending guest(s) leave the property.
The use of firearms, deadly weapons, pyrotechnics and illegal drugs are prohibited.
14. Staff at the Properties
There are some properties that may require the service of extra staff. These extra services like cooks and drivers can be taken care of. However, kindly endeavor to give enough notice as early as possible, most especially during the holiday season. We shall try our very best to assist you.
Properties Away is not responsible for such contracted staff. The cost for acquiring these services shall be provided to the client in advance and shall be paid for by the guest.
15. Valuables
We have a safe in one of the rooms of all our properties, if this is not the case, a safe is available at the properties owners’ office. Aside this any other property is at the tenant’s risk. Properties Away or the properties owners or the properties’ staff are not going to be held responsible for their loss or damage.
16. Linen & Towels
Normally we don’t include Linen and towels in all our properties. But in situations where they are included they are changed in 7 days intervals. If you are interested in changing more frequently, this comes at an extra cost. There may be laundry services available at the properties but standard charges may apply. For external services payment is due to the time the service is incurred.
17. Due Care of the Facilities
Included in this agreement is an understanding that guests would be required to handle all property facilities with extra care and caution.
In addition, guest are always advised not to enter the premises of the building or into the building itself wet as the floors can be very slippery. Any damage or injury which may arise as a result of this is not the responsibility of Properties Away.
18. Applicable Law
These conditions and any contract to which they apply are governed in all respects by the applicable Thai law, and the Thai courts only shall have jurisdiction in relation to any claim or dispute arising out of, or connected with them.
